I don't know that the article implied that you would have to agree *never* to have children, or to use condoms indefinitely, I assumed that was for the initial trial period. And, as someone else said...there's really no way to monitor or enforce such a thing indefinitely.
I would think the over-40 qualification reduces the potential conflicts of interest anyway - for women, having children past 40 is very high-risk, even if still possible. More so for T1 women. So I don't think that would be a huge issue. Men are not quite as age-limited there, but still I think men who father kids at that age are in the minority.
