Frankly I find one part of his story suspicious: that his BG was 98 and that he drank two cups of sugared coffee before leaving. My guess is that he is claiming this as protection from the lawsuit. I could of course be wrong - the story doesn't state whether his meter recorded that value or whether he took an injection shortly before leaving - either of which would significantly affect his credibility and culpability.

I find it more likely that he already had a severely low BG when he left his apartment (why else leave his cell phone on his bed and TV on when he was leaving for the trip to his girlfriends?) I have awoken from very low BG and stumbled downstairs to get OJ - and under those conditions wouldn't have noticed whether I had my TV on - but anyone who decides to drive in that state deserves to be prosecuted.

In any case, I believe HE has lost the privilege to drive, even if his story is true. If his BG is that unstable, then he shouldn't be driving. I don't want a case like this to be used as evidence why ALL diabetics should have restrictions on their licenses.
